Insurance companies are not obligated to use any particular method when calculating pain and suffering. In fact, many insurance companies use computer programs to determine the value of a claim, such as the Colossus software. Insurance companies will also consider factors such as whether the injuries were treated by a doctor, a specialist, or by a chiropractor. Insurance companies will also consider the length of treatment. If the insurance adjuster thinks the injured victim treated too much, then the insurance company will not include those appointments in the pain and suffering calculation. Any gaps or lengths of time in between treatments will also be heavily weighed against the injured victim on the basis that if you are seriously injured you will do anything to get better.
