The hundreds of aggrieved concertgoers seeking damages upwards of $2 billion may not get get their days in court because the terms of service on the Live Nation website, where most bought their tickets, state that arbitrators, not the court system, will settle disputes. The Federal Arbitration Act was never intended to be used to supplant the court system in cases of wrongful death and injury, yet decisions by the U.S. Supreme Court have stretched that law far beyond its original purpose.
